Terms of Use

Effective date: November 2, 2026

These Terms of Use (the "Terms") are an agreement between you and Andrii Sukhostavets, an individual developer based in the United States, who makes and operates Ekvila ("we", "us", "our"). They apply to the Ekvila iPhone app, its beta versions, its cloud features and the website ekvila.com (together, the "Service").

Please read them carefully. By installing or using the Service, or by creating an account, you agree to these Terms. Our Privacy Policy explains how we handle your data. If you do not agree, do not use the Service.

Important health notice. Ekvila is a training and nutrition diary with general information. It is not a medical device and does not give medical advice. Exercise and diet changes carry risks. Read section 4 before you start.

1. Who can use Ekvila

  1. You must be at least 16 years old to use the Service, or older if the law of your country sets a higher age for using such services without parental consent.
  2. Coach features (section 7) and meal plans are for adults only. You must be at least 18 years old to turn on coach mode, to connect with a coach, and to use meal plans; the app asks you to confirm your age and does not offer these features to users who entered an age under 18.
  3. You may not use the Service if you are barred from doing so under the laws of the United States or of the country where you live, including sanctions laws.
  4. The Service is not offered in every country. In particular, it is not offered in Russia, Belarus or mainland China.

2. Beta versions

Ekvila is currently offered as a free beta, including through Apple's TestFlight. A beta can contain errors, can lose data and can change or end at any time without notice. Do not rely on a beta for anything critical, and keep your own copy of information that matters to you. If you join the beta, you agree that we may contact you by email about the beta and that you will not publicly share confidential features that are clearly marked as unreleased.

3. Your account

  1. The app works without an account; your data then stays on your device. An account is optional and is needed only for sync between devices, AI food recognition and coach features.
  2. You sign in with a one-time code sent to your email. Keep access to your email secure. You are responsible for what happens in your account.
  3. Give accurate information and keep it up to date. One person may have only one account, and you may not create an account for someone else without their permission.
  4. You can delete your account at any time in the app (Profile → Account → Delete account). This deletes your cloud data as described in the Privacy Policy.

4. Health and safety — please read

  1. Not medical advice. All content in the Service — calorie and macro targets, weight-goal pace, water targets, meal plans, recipes, exercise descriptions and technique tips, calorie estimates, product scores and AI estimates — is general information for healthy adults. It is not medical, nutritional or psychological advice, diagnosis or treatment, and it does not replace a doctor, registered dietitian or qualified trainer.
  2. Talk to a doctor first before you start or change an exercise or nutrition program, especially if you have a heart, lung, metabolic, joint or other medical condition, high blood pressure, diabetes, an injury, an eating disorder or a history of one, if you are pregnant or breastfeeding, if you take medication, or if you are under 18.
  3. Exercise carries a risk of injury. Warm up, use a weight you can control, use proper technique, use spotters and safety equipment for heavy lifts, and follow the safety notes in each exercise. Stop immediately and seek medical help if you feel pain, dizziness, chest pain, shortness of breath or any unusual symptom.
  4. Food and allergies. Meal plans and recipes are generated automatically from our recipe library and average food composition data. They may not suit your needs, and ingredients from different brands can differ. Always check product labels for allergens and ingredients yourself. Never rely on the app alone if you have a food allergy, intolerance or medical diet.
  5. Estimates are approximate. Calories burned, calorie targets, nutrition values of products, the product quality score and AI meal recognition are estimates that can be wrong.
  6. Emergencies. The Service is not an emergency service. In an emergency, call your local emergency number.
  7. You are responsible for your own decisions about exercise, diet and health. To the extent the law allows, you use the Service at your own risk.

5. Your content

  1. "Your Content" means everything you add to the Service: workouts, results, body measurements, food diary entries, notes, photos, messages, your name and the like. You keep all rights to Your Content.
  2. You give us a worldwide, non-exclusive, royalty-free permission to store, copy, process, transmit and display Your Content only to operate and provide the Service to you — for example, to sync it between your devices, to show it to a coach you have connected, and to keep the Service secure. This permission ends when Your Content is deleted from the Service, except for copies we must keep by law or for safety reasons described in the Privacy Policy.
  3. Only add content that you have the right to use. Do not upload photos of other people without their permission.

6. Acceptable use

When using the Service, you must not:

  • break the law or help anyone else break it;
  • try to access other users' accounts or data, or test, scan or bypass the security of the Service;
  • interfere with the Service, overload it, or use bots, scrapers or other automated means to access it;
  • copy, modify, reverse-engineer, decompile, sell, rent or resell the app or the Service, except where the law allows this despite this restriction;
  • use the Service to build a competing product, or extract our exercise, technique or recipe content in bulk;
  • upload malware or harmful code;
  • harass, threaten or harm others, or break our Community Guidelines.

7. Coach features

  1. What they are. Coach mode is only for users aged 18 or over; by turning it on you confirm that you are. A coach can send a connection request to another user by entering that user's personal code. If the user (who must also be 18 or over) accepts, the coach can see the copy of that user's app data stored in our cloud, and can create, change and delete that user's workouts, replace their meal plan, and chat with them. A coach can have up to 3 clients at a time (we may change this limit).
  2. The client is in control. Before the client accepts, the coach sees only the client's display name, and the client sees the coach's display name. Data is shared only after the client accepts the request, having been shown what the coach will be able to see and do. The client can disconnect or block the coach at any time. After disconnection the coach loses access to the client's data; workouts already sent stay in the client's app, and the chat history stays readable for both until either of them deletes their account.
  3. We do not check coaches. We do not verify the identity, qualifications, licences or experience of coaches, and the coach badge does not mean we endorse or recommend anyone. A coach is not our employee, agent or partner.
  4. The coaching relationship is between coach and client. We are not a party to it. Any agreement, payment, advice or dispute between a coach and a client is solely between them. The Service does not process payments between coaches and clients.
  5. Coach advice is not ours and is not medical advice. Clients should use their own judgement and the health notices in section 4 for anything a coach suggests.
  6. Coaches' obligations. If you act as a coach, you agree:
    • to use a client's data only to coach that client, inside the Service, and to keep it confidential;
    • not to copy, export, publish, sell or share a client's data, and not to contact the client's contacts;
    • to comply with the laws that apply to you, including data protection, consumer, professional and tax laws; if you use a client's data outside the Service, you do so as an independent controller under your own responsibility;
    • not to present yourself as a doctor, dietitian or other licensed professional unless you are one, and not to diagnose or treat medical conditions through the Service;
    • not to suggest dangerous practices, such as extreme calorie restriction, performance-enhancing drugs, or training through pain or injury;
    • to stop coaching a client when they ask you to.
  7. We may limit, suspend or remove coach features or coach accounts that break these Terms.

8. Chat, reports and blocking

  1. Chat is available between a coach and a client while their connection is active. Messages are not end-to-end encrypted; we do not read them in normal operation, but we may review a message and the surrounding conversation when it is reported, to enforce these Terms or when required by law.
  2. You can report any message or user from within the app, and you can block the other person at any time.
  3. We do not tolerate objectionable content or abusive users. We aim to review reports within 24 hours and may remove content, block users and close accounts that break the Community Guidelines, without prior notice where the situation requires it.
  4. We may use an automated filter to stop messages and names that contain blocked words.

9. Third-party content and services

  1. Product data in the scanner comes from Open Food Facts, an independent community database, and is licensed under the Open Database License (ODbL). It may be incomplete or wrong. Nutri-Score grades shown in the app come from Open Food Facts and are not issued or endorsed by the owners of the Nutri-Score label.
  2. AI food recognition uses an AI provider (Anthropic) to estimate foods and portions from a photo. Results are estimates and may be wrong; check them before saving.
  3. Apple Health. If you turn it on, the app writes your completed workouts and estimated calories to the Health app. Apple's terms govern the Health app.
  4. We are not responsible for third-party services, websites or content that the Service links to or uses, and their own terms and privacy policies apply to them.

10. Our rights and your licence to use the app

  1. The Service, including the app, its software, design, name, logo, illustrations, exercise descriptions, technique texts, recipes and other content we provide, belongs to us or our licensors and is protected by copyright, trademark and other laws. All rights not expressly granted to you are reserved.
  2. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app on Apple devices that you own or control, for your personal, non-commercial use (coaches may use coach features as part of their coaching work), in line with these Terms and the Apple terms below.
  3. Some parts of the app are open-source software, which is licensed under its own licences; you can see them in the app under Profile → Open-source licenses. Nothing in these Terms limits your rights under those licences.
  4. If you send us ideas or feedback, we may use them freely without any obligation to you.

11. Apple terms

  1. If you got the app from the App Store or TestFlight, your use of the app is also governed by Apple's Licensed Application End User License Agreement ("Apple's EULA"). These Terms supplement Apple's EULA; if they conflict, Apple's EULA applies to the app licence.
  2. These Terms are between you and us only, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to the app (including product liability, legal or regulatory claims, or intellectual-property claims). We, not Apple, are responsible for handling such claims to the extent described in these Terms.
  3. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as they relate to the app licence.
  4. TestFlight is provided by Apple under Apple's own terms; Apple may collect information about your use of beta builds under its own privacy policy.

12. Price

The Service is currently free. If we introduce paid features or subscriptions, we will show the price and conditions before you buy. Purchases in the app are processed by Apple under Apple's terms, and refunds are handled by Apple.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available". We do not promise that the Service will be uninterrupted, error-free, secure or free of data loss, that calculations, estimates, product data, technique descriptions or AI results are accurate or complete, or that the Service will achieve any particular fitness, weight or health result. To the extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title and non-infringement.

14. Limitation of liability

  1. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or business, arising from or related to the Service.
  2. To the maximum extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim and (b) USD 50.
  3. We are not liable for the content, actions or advice of other users, including coaches and clients.
  4. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct, and nothing affects your mandatory rights as a consumer under the law of the country where you live. If you live in the European Union, the United Kingdom or another country with such rules, sections 13 and 14 apply only to the extent permitted by that law.

15. Indemnity

If you use the Service in breach of these Terms or the law — for example, by misusing a client's data as a coach or posting unlawful content — you agree to compensate us for reasonable losses and costs (including reasonable legal fees) resulting from claims by third parties caused by that breach. This section does not apply if you are a consumer in the EU/EEA, the United Kingdom or another country whose law does not allow it.

16. Suspension and termination

  1. You can stop using the Service at any time and delete your account in the app.
  2. We may suspend or close your account, or remove content, if you seriously or repeatedly break these Terms, if your use creates a risk for other users, for us or for the Service, or if the law requires it. Where reasonable, we will tell you why and give you a chance to respond. We may end the beta or the Service as a whole; if we do, we will try to give reasonable notice so you can export or record your information.
  3. Sections that by their nature should continue after termination (for example, sections 4, 5.2, 10, 13–15, 18 and 19) continue to apply.

17. Changes to the Service and to these Terms

We may change the Service as it develops. We may also update these Terms. If a change is significant, we will tell you in the app or by email before it takes effect. If you keep using the Service after the change takes effect, the updated Terms apply. If you do not agree, stop using the Service and delete your account.

18. Governing law and disputes

  1. If you have a problem, please contact us first at support@ekvila.com. Most issues can be solved quickly, and we will try to resolve yours within 30 days.
  2. These Terms are governed by the laws of the State of New York, USA, and applicable US federal law, without regard to conflict-of-law rules. The courts located in that state have jurisdiction, and you may also bring a claim in a small-claims court where you qualify.
  3. If you are a consumer living outside the United States, you also keep the protection of the mandatory laws of your country of residence, and you may bring a claim in the courts of that country.

19. General

  1. These Terms, together with the Community Guidelines, are the entire agreement between you and us about the Service. The Privacy Policy and the Consumer Health Data Privacy Policy explain how we handle your data.
  2. If any part of these Terms is found unenforceable, the rest stays in force.
  3. If we do not enforce a right immediately, we do not give it up.
  4. You may not transfer your rights under these Terms. We may transfer ours to someone who takes over the Service, provided your rights are not reduced; we will tell you if that happens.
  5. These Terms are published in several languages. If there is a conflict between versions, the English version applies, unless the law of your country requires otherwise.
